GENERAL TERMS AND CONDITIONS Out in the Green

1. General terms and conditions

  • Out in the Green is a festival organised by First Event AG, hereinafter referred to as the “Organiser”.
  • By purchasing a ticket to the festival, the purchaser accepts these General Terms and Conditions. The holder of a ticket who has not purchased his ticket through the ticket providers designated by the Organiser or otherwise become the holder of a ticket accepts these General Terms and Conditions at the moment he takes possession of the ticket.
  • The Festival will take place outdoors in all weathers.
  • The instructions of the organiser’s staff must be strictly followed. Failure to do so will result in expulsion from the festival area without refund of the ticket purchase price. The organiser reserves the right to take civil and criminal action.
  • The festival area consists of the following cordoned-off sections: Festival area and the festival car park. Access to the festival area or to individual sub-areas is only possible with a valid admission ticket at the access times published for the respective category on the organiser’s website.
  • Festival visitors agree that they may be filmed and/or recorded as part of the audience and that these recordings may be used and exploited commercially and without compensation. He expressly and irrevocably waives the assertion of his personal rights in this respect.
  • Persons under 16 years of age may only enter the event if accompanied by an adult. The organiser declines all responsibility and/or liability in the event of non-compliance.

 

2. Program

  • The organiser has no influence on the design and content of the artists’ performances. The organiser accepts no liability in this respect.
  • The organiser reserves the right to change the content and/or the programme of the festival at any time and without prior notice.

 

3. Noise immission

  • During concerts, there may be a risk of possible damage to hearing and health due to the volume of noise. Hearing protection plugs will be handed out at the entrances to and at special locations in the festival area.
  • The organiser declines all responsibility for any damage to hearing or health.

 

4. Security

  • The organiser’s security service will carry out security and entry checks at all official entrances to and along the festival site and throughout the duration of the festival.
  • The security service will carry out random bag checks and body searches in consultation / cooperation with the local police authorities.
  • The right to deny festival visitors entry to the festival area or to expel them from the festival area for good cause is reserved. If the festival visitor is not at fault, the organiser may, at its own discretion, refund the purchase price of the ticket. Failure to comply with these General Terms and Conditions shall constitute good cause.

 

5 Access to and behaviour on the festival site

5.1 Traffic

  • Parking on the access roads to the festival area and on the festival area (excluding festival parking areas) is strictly prohibited.
  • Vehicles parked on the access roads or not on the festival parking area will be towed away without prior notice and at the owner’s expense. The vehicle owner will be charged and must bear all expenses once the towing service has been ordered.
  • Vehicles are parked at the owner’s own risk.
  • If possible, public transport is to be used.

 

5.2 Admission

  • The admission ticket must be exchanged for a control wristband at the official ticket offices and exchange stations of the organiser. The control bracelet is personal and non-transferable.
  • Every person entering the festival area (excluding the festival car park) must wear the control bracelet firmly fastened around the wrist before entering.
  • Damaged wristbands and wristbands not firmly fastened around the wrist do not entitle the wearer to use the services of the organiser, in particular not to admission, and are invalid.
  • Depending on the wristband, the control wristband entitles the wearer to enter the festival grounds for the period of time stated on the admission ticket.
  • Lost admission tickets, free tickets or control bracelets will not be replaced.
  • Persons who are on the festival grounds (excluding the festival car park) without a properly fastened wristband will be turned away and reported.
  • The organiser reserves the right to change the admission times without prior notice. The organiser accepts no liability for delays in admission.

5.3 Recordings

  • Picture, sound, film and video recordings of the artists and athletes performing at the festival are not permitted. Recordings for private use are generally permitted.
  • The commercial use and exploitation of picture, sound, film and video recordings of the artists and athletes performing at the festival, of festival visitors or of the festival infrastructure is prohibited.
  • Violations will be prosecuted under civil and criminal law.

5.4 Further rules

  • Prohibited objects and animals on the festival area are:
    • Parasols, umbrellas and (flag) poles.
    • All firearms, spray weapons, stabbing weapons, percussion weapons and other objects classified as dangerous, in particular pocket knives.
    • Cameras with digital or analogue reflex cameras with/without interchangeable lenses, film and video cameras as well as audio recording devices
    • Selfie and GoPro sticks, etc.
    • Drones and other airworthy devices, with or without cameras
    • Rollerblades, skateboards and kickboards, roller skates, bicycles, prams, etc.
    • Glass
    • Pyrotechnic objects, petards, dry ice
    • Animals
  • A deposit of CHF 2.00 will be charged for each drink purchased on the festival grounds. The deposit will be refunded at all bars and beverage stands. Organised collection of deposits by individuals or organisations – even under the guise of a “good cause” – is prohibited without prior agreement with the organiser. In case of infringement, these persons will be expelled from the festival area without refund of the ticket purchase price.

 

6. Admission tickets

Tickets may only be purchased through the ticket providers designated by the Organiser.

6.1 Covid-19 / 3G measures:

At this point in time, we are not yet able to provide information on any measures regarding Covid-19. Depending on the development of the pandemic, we will communicate this at an early stage.

6.2 Right of return or refund

In principle, there is no right to return the admission ticket or claim a refund of the purchase price of the admission ticket. Exception:

  • Positive Covid-19 test: If the festival cannot be attended at short notice due to a positive test result, a refund of the ticket can be requested via the online form on the homepage.

6.3 Resale of tickets

The purchase of tickets for the purpose of resale is prohibited. The organiser will carry out appropriate checks and may block and declare invalid any tickets purchased for the purpose of resale. The organiser reserves the right to take civil and criminal action.

 

7. Liability

  • To the extent permitted by law, any liability of the organiser for its own conduct and for the conduct of its auxiliary persons is excluded. In particular, the organiser and its auxiliary persons shall not be liable for bodily injury or financial loss caused to festival visitors by third parties (e.g. stand operators).
  • The organiser is not responsible for lost or stolen items. Lost property will be handed over to the Frauenfeld lost property office after the festival.

 

8. Final provisions

  • If the Festival has to be cancelled or postponed due to force majeure (e.g. war, death or illness of an artist, bad weather, catastrophes, riots, danger of terrorism, warning or act of terrorism, epidemics, pandemics, official prohibition or non-permission of the Festival through no fault of the organiser, etc.), there is no entitlement to the return of the ticket or to a refund of the purchase price of the ticket, but the ticket can only be exchanged for a ticket for the next edition of the Festival. In exceptional cases, the organiser may decide, at its own discretion and on a case-by-case basis, to refund the purchase price of the ticket instead, less a handling fee of 10% of the purchase price (maximum handling fee CHF 50.00). There is no entitlement to this. Exception according to article 6.2.
  • If the Festival has to be interrupted or cancelled due to force majeure, there is no entitlement to the return of the ticket, to a refund of the purchase price of the ticket or to an exchange for the next edition of the Festival. Any temporary interruption of the Festival from the opening of the Festival (e.g. due to bad weather) is deemed to be an interruption of the Festival. An interruption of the Festival shall be deemed to be any interruption of the Festival occurring after the opening of the Festival (e.g. due to an official ban).
  • Changes to these General Terms and Conditions must be made in writing.
  • There are no subsidiary agreements.
  • The organiser reserves the right to amend these General Terms and Conditions at any time. Amendments shall be deemed to have been accepted unless objected to within 30 days of publication.
  • These General Terms and Conditions shall be governed exclusively by Swiss law, to the exclusion of its conflict-of-law rules and the Vienna Sales Convention. The place of jurisdiction for all disputes shall be exclusively Frauenfeld, Switzerland.
